Purchase rules

 

  1. CONNECTIONS

1.1. The Seller – UAB “Meda Lt”, registered office address Šaltalankių g. 1, Klevinė, LT-14180 Vilniaus r., company code 303245883, VAT payer code LT100008381214. Seller’s contacts: phone +370 5 246 0054, e-mail info@meda.lt.

1.2. ” Online Shop ” means the online shop located at www.meda.lt and www.meda.ee.

1.3 ” Customer ” means a person who orders or purchases goods in the Online Shop.

1.4 Personal Data – the Customer’s data specified in the Privacy Policy.

1.5 Privacy Policy – a document approved by the Seller, which is available on the website at www.meda.lt and www.meda.ee, and which contains the main provisions on the collection, collection, processing and storage of Personal Data and other related aspects.

1.6 ” Terms and Conditions ” means these Terms and Conditions of Purchase, which describe the provisions relating to the purchase of goods in the Online Shop.

1.7 Account – the result of the Customer’s registration in the Online Shop, which results in the creation of an account, where the personal data provided by the Customer and the data on orders placed in the Online Shop are stored.

 

  1. GENERAL PROVISIONS

2.1. These Terms and Conditions are a legal document to which both the Buyer and the Seller must adhere. Together with the order placed by the Buyer, these Terms and Conditions shall become a contract of sale between the Buyer and the Seller and shall constitute a binding legal document for both parties. We recommend that you read the Terms and Conditions and Privacy Policy carefully before ordering goods from the Online Shop.

2.2. The purchase and sale contract between the Buyer and the Seller shall be deemed to have been concluded from the moment when the Buyer has created a shopping cart in the Online Shop, indicated the delivery address, selected the payment method and read the Terms and Conditions, ticked the “I agree” box and clicked the “Confirm” button. The Purchase and Sale Agreement shall remain in force until the obligations under this Agreement have been fully performed.

2.3. By registering or placing an order in this Online Shop, the Customer unconditionally confirms that he/she is entitled to purchase goods in the Online Shop.

2.4. In order to confirm the correctness of the data provided when registering an Account in the Online Shop, an e-mail is sent to the Customer requesting confirmation of the data provided.

2.5. The Seller reserves the right to change, amend or supplement the Terms and Conditions. When shopping in the Online Shop, the Buyer shall be subject to the Terms and Conditions in force at the time of placing the order.

 

3. RIGHTS AND OBLIGATIONS OF THE BUYER

3.1. The Buyer has the right to:

a) Purchase goods in the Online Shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.

b) To withdraw from the Purchase and Sale Agreement concluded in the Online Shop and return/exchange the purchased goods by notifying the Seller in writing no later than within 14 days from the date of delivery of the ordered goods in accordance with the procedure set out in the Lithuanian legislation and the present Rules. If the Buyer decides to withdraw from the Sale and Purchase Agreement and informs the Seller thereof, the Seller shall refund the amount paid by the Buyer in accordance with the procedure set out in Section 8 of the Chapter of the Rules.

c) Return or replace goods purchased in poor quality, and make use of warranties applicable to the goods in accordance with the procedures set out in Lithuanian legislation and these Rules.

3.2. The Buyer undertakes:

a) Protect and not disclose your Account login details to third parties.

(b) Ensure that all data provided during the procurement process are accurate and correct.

c) Pay the price of the goods ordered and their delivery and accept the goods ordered.

d) Upon receipt of the goods, to inspect and check them, and to immediately inform the Seller of any damage to the consignment, defects in the goods, or inconsistencies in the model or the equipment of the goods.

e) Comply with any other requirements set out in Lithuanian legislation and these Rules.

 

  1. RIGHTS AND OBLIGATIONS OF THE SELLER

4.1. The seller has the right to:

a) To complete, remove or correct any information on the Online Shop.

b) Cancel the order if the Buyer pays for the goods, but it is not possible to deliver the goods to the address specified by the Buyer and the Buyer cannot be contacted within 14 days, either by telephone or by e-mail. by post. The Buyer’s order is cancelled and the goods are returned to the Seller. The seller is then entitled to deduct delivery and preparation costs from the amount paid.

c) Terminate the contract of sale when, due to unforeseen circumstances related to the supply of the goods or the fact that the goods are out of stock, the Seller is unable to deliver the goods purchased in the Online Shop, informing the Buyer thereof. In this case, the Seller may offer the Buyer a similar product, but if the Buyer refuses to replace the product, the Seller undertakes to refund the money paid by the Buyer within 5 working days to the Buyer’s account from which the payment was made.

d) Restrict the Customer’s use of the Online Shop or cancel the Customer’s registration if the Customer uses the Online Shop in violation of these Terms and Conditions or attempts to undermine the stability and security of the Online Shop.

4.2. The Seller undertakes:

a) Make the Online Shop available.

b) Deliver the purchased goods by the delivery method chosen by the Buyer, in accordance with the terms and conditions set out in the Rules.

c) To continuously improve the functions of the Online Shop, to ensure that the information contained therein is accurate, however, the Seller shall not be liable for any loss or damage caused by an attack on information systems, virus or other software or technologically harmful or harmful material that may affect the computers, IT equipment, data of persons using the Online Shop.

 

  1. ORDER

5.1. The price of the Goods as stated in the Online Shop at the time of placing the order is final and valid for both the Buyer and the Seller, except in the case of obvious error. If the Seller discovers that the price of any goods ordered by the Buyer is incorrect, the Seller will inform the Buyer as soon as possible and the Buyer will be given the opportunity to confirm the order with the correct price or to cancel the order. If the Seller is unable to contact the Buyer, the order will be deemed cancelled and all amounts paid by the Buyer will be refunded to the Buyer. Prices in the Online Shop are in euros and include VAT. The price of the Goods may be increased by the cost of delivery of the Goods, which depends on the delivery chosen.

5.2. The Buyer may order and purchase goods in the Online Shop in one of the following ways:

a) by registering on the Online Shop and creating an Account, by providing the mandatory data during registration. The Buyer can log in to his Account by entering the email address provided during registration and a password devised by the Buyer;

(b) by not registering an Account on the Online Shop. In this case, the Buyer must provide his/her name, surname, e-mail address, telephone number, delivery address and other requested data.

5.3. Confirmation of the order will be provided to the Buyer at the Buyer’s email address provided at the time of order confirmation.

 

  1. PAYMENT FOR GOODS

6.1. You can pay for your goods by online banking or by direct bank transfer.

6.2. The Buyer shall pay for the goods in one of the following ways:

a) electronic banking (using the Paysera mokėjimai.lt payment system);

(b) by bank transfer against a forward invoice. If this payment method is chosen, the Buyer must indicate his/her order number (e.g. #1234) in the payment destination field;

c) by bank card at the company’s registered office (Šaltalankių g. 1, Klevinė, 14180 Vilniaus r.) ___

6.3. The Buyer undertakes to pay for the goods promptly. Goods are prepared and dispatched only after the Buyer has paid for the order.

6.4. The Buyer agrees that the Seller will invoice in electronic form.

6.5. If the Buyer pays for an order in the Online Shop by bank transfer from abroad and subsequently returns the goods, additional bank transfer fees may apply. The Buyer shall pay these additional costs associated with the bank transfer.

  1. DELIVERY OF GOODS

7.1. When purchasing goods in the Online Shop, the Buyer shall choose the method of delivery and provide the exact delivery address.

7.2. We deliver in Lithuania, Latvia and Estonia.

7.3. Delivery to other foreign countries is by separate arrangement and at an additional cost. To place an order in a foreign country, please contact us at info@meda.lt or +370 5246 0054.

7.4. Delivery in Lithuania:

a) Delivery to your home, work or other specified address via DPD courier. For orders over EUR 45, delivery is FREE. Otherwise €3.99.

b) Delivery to a DPD Pickup post office. For orders over EUR 45, delivery is FREE. Otherwise, €2.49.

c) All orders may be collected by the Buyer FREE OF CHARGE from Vilnius, Šaltalankių str. 1-1, Klevine.

d) Delivery to Curonian Spit using courier services is charged extra + 22 €.

e) If the goods are in the Seller’s warehouse, the delivery time is 2 – 4 working days. If the ordered item is out of stock, the delivery time is 1 – 4 weeks.

7.5. Delivery in Latvia:

a) Delivery to your home, work or other specified address via DPD courier. For orders over EUR 99, delivery is FREE. Otherwise €10.99.

b) Delivery to a DPD Pickup post office. For orders over EUR 99, delivery is FREE. Otherwise, €5.49.

c) If the goods are in the Seller’s warehouse, the delivery time is 4 – 5 working days. If the ordered item is out of stock, the delivery time is 2 – 4 weeks.

7.6. Delivery in Estonia:

a) Delivery to your home, work or other specified address via DPD courier. For orders over €129, delivery is FREE. Otherwise, €12.49.

b) Delivery to a DPD Pickup post office. For orders over €129, delivery is FREE. Otherwise, €6.49.

c) Delivery to the Estonian islands by courier will be charged at an extra cost of + 14 €.

d) If the goods are in the Seller’s warehouse, the delivery time is 4 – 5 working days. If the ordered item is out of stock, the delivery time is 2 – 4 weeks.

7.7. The Buyer undertakes to accept the goods. If the Buyer is unable to take delivery of the goods and the goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not have the right to claim against the Seller for delivery of the goods to the wrong entity.

7.8. The Seller shall be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault.

7.9. Upon receipt of the goods, the Buyer must check the condition of the consignment (whether the outer packaging is damaged). If the Buyer notices that the packaging of the delivered parcel is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must note this on the delivery and acceptance document, or, in the case of goods delivered by courier, draw up a certificate of damage to the packaging, and inform the Seller thereof. If the Buyer fails to do so, the Seller shall be exempt from liability for any damage to the goods and for any inconsistencies in the assembly of the goods, provided that such inconsistencies can be detected by an external inspection of the goods. Buyers who have collected their parcels from self-service terminals and notice discrepancies must inform the Seller immediately.

7.10. The characteristics of all the goods for sale are indicated in the description of each item in the Online Shop. The Seller shall not be liable for the fact that the colour, shape or other characteristics of the goods in the Online Shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.

 

  1. RETURN OF GOODS

8.1. The Buyer may replace or return defective goods within 14 days of receipt of the goods.

8.2. Almost all goods can be exchanged or returned, provided that they have not been used, are intact, have retained their usable qualities, have not lost their merchantable appearance, and that you have proof that the goods were purchased from the Seller’s email address. in the shop (i.e. the Buyer provides the order number or invoice number). Packaged goods that have been unpacked after delivery and are unsuitable for return for health or hygiene reasons (e.g. cosmetics, disposable masks, toiletries, etc.) cannot be exchanged or returned.

8.3. The goods being exchanged or returned must be in their original undamaged packaging, with their labels intact and in the same condition. If the goods are not complete, are not in good condition, have damaged packaging or show clear signs of use, the Seller has the right not to accept the goods, not to replace them and not to refund the money paid for them.

8.4. In order to return an item purchased in the Online Shop, the Buyer must contact the Seller by phone +370 52460054 or by e-mail info@meda.lt to arrange the return.

8.5. Goods are returned to UAB “Meda LT”, address Šaltalankių g. 1-1, Klevinė, 14180 Vilniaus r.

8.6. If the goods are returned by courier services, the Buyer must pack the goods properly to prevent damage during shipment. If the goods are damaged during shipment, the Seller has the right not to accept the goods.

8.7. The Seller shall transfer the amount paid for the Goods to the Buyer’s bank account within 7 days from the date of return. The money will be refunded to the same bank account used to pay for the product.

8.8. Goods of good quality shall be returned by the Buyer at the Buyer’s expense.

  1. GUARANTEES

9.1. The characteristics of each item in the Online Shop are generally indicated for each item.

9.2. Certain goods are covered by a manufacturer’s warranty, the specific term or other terms of which are specified in the descriptions of such goods in the Online Shop and detailed in the product’s warranty card.

9.3. If you notice a defect during the use of the product, please report it to the contacts listed in 1.1 of these Terms and Conditions. Para. Quantitative or qualitative discrepancies found during the warranty period shall be corrected, completed or replaced by the Seller at its own expense. The Seller undertakes to remedy the manufacturing defect within 15-45 working days from the date of registration of the claim with the company.

9.4. The Buyer loses the right to free after-sales service in the following cases:

(a) the goods have been damaged through the fault of the buyer;

(b) the goods have suffered damage as a result of Force Majeure.)

9.5. The Seller may inspect, repair, recondition, upgrade and carry out other maintenance work on many appliances, even during the post-warranty period, at the Buyer’s request and for an additional fee.

 

  1. PROCESSING OF PERSONAL DATA

Personal data provided by the Customer shall be processed in accordance with the terms and conditions specified in the Privacy Policy.

 

  1. FINAL PROVISIONS

11.1. The Seller reserves the right to amend and supplement these Terms and Conditions and any other documents relating to these Terms and Conditions at any time. Amendments or changes to the Terms and Conditions shall come into effect from the date of their publication, by posting on the Online Shop. When purchasing in the Online Shop, the rules in force at the time of placing the order apply.

11.2. The Parties shall be excused from the performance of their obligations under these Terms and Conditions if such performance is not possible due to unforeseeable circumstances beyond the control of the Parties, as provided for in the Rules on Exemption from Liability in the Event of Force Majeure and other legal acts of the Republic of Lithuania approved by the Government of the Republic of Lithuania.

11.3. All copyrights and other intellectual property rights in the textual or graphic content of the Online Shop belong to the Seller or the third party providing the content. It is forbidden to use or distribute the content of the Online Shop without the written consent of the Seller.

11.4. The Seller accepts no risk and is unconditionally relieved of liability if the Buyer has not fully read these Terms and Conditions, even if given the opportunity to do so.

11.5. The law of the Republic of Lithuania shall apply to relations arising under these Rules. Any disagreements arising out of the application of these Terms and Conditions shall be settled by negotiation in good faith. In the event of disagreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
