Purchase rules

 

1. Concepts

1.2. e-shop – an electronic store located on the website at www.meda.lt ir www.meda.ee.

1.3. Buyer – a person ordering or purchasing goods in the Online Store.

1.4. Personal details – Buyer data specified in the Privacy Policy.

1.5. Privacy Policy – A document approved by the seller, which is available on the website at www.meda.lt at www.meda.ee and which provides basic provisions regarding the collection, storage, processing and storage of Personal Data and other related aspects.

1.6. The rules – these purchase rules, which describe the provisions related to the purchase of goods in the Online Store.

1.7. Account – The result of the Buyer's registration in the Online Store, which results in the creation of an account, which stores the personal data provided by the Buyer and data about orders in the Online Store.

 

2 General provisions

2.1. These Rules are a legal document that must be followed by the Buyer and the Seller. Together with the order submitted by the Buyer, these Rules become a Purchase and Sale Agreement concluded between the Buyer and the Seller and are a binding legal document for both parties. Before ordering goods in the Online Store, we recommend that you carefully read the Rules and Privacy Policy.

2.2. The Purchase and Sale Agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the Online Store, specified a delivery address, selected a payment method and familiarized himself with the Rules, ticks the box "I agree" and clicks the "Confirm" button. The Purchase and Sale Agreement is valid until the obligations under this Agreement are fully fulfilled.

2.3. By registering or placing an order in this Online Store, the Buyer unconditionally confirms that he has the right to purchase goods in the Online Store.

2.4. In order to confirm the accuracy of the data provided when registering an Account in the Online Store, an email is sent to the Buyer requesting confirmation of the data provided.

2.5. The Seller reserves the right to change, amend or supplement the Rules. When the Buyer makes purchases in the Online Store, the Rules in force at the time of placing the order apply.

 

3. Buyer's rights and obligations

3.1. The Buyer has the right:

a) Purchase goods in the Online Store in accordance with these Rules and the legal acts of the Republic of Lithuania.

b) To withdraw from the Purchase and Sale Agreement concluded in the Online Store and return/replace the purchased goods, notifying the Seller in writing no later than 14 days from the date of delivery of the ordered goods in accordance with the procedure established by Lithuanian legislation and these Rules. If the Buyer decides to withdraw from the Purchase and Sale Agreement and informs the Seller thereof, the Seller shall refund the amount paid by the Buyer in accordance with the procedure established in Section 8 of the Rules.

c) Return or replace purchased goods of poor quality, use the guarantees applicable to the goods in accordance with the procedure established by Lithuanian legislation and these Rules.

3.2. The buyer undertakes:

a) To store and not transfer your Account login details to third parties.

b) Ensure that all data provided during the purchase is accurate and correct.

c) Pay the price of the ordered goods and their delivery and accept the ordered goods.

d) Upon receipt of the goods, inspect and check them, and immediately inform the Seller about any damage to the shipment, defects in the goods, or discrepancies in the model or configuration of the goods.

e) Comply with other requirements provided for in Lithuanian legislation and these Rules.

 

4. Seller's rights and obligations

4.1. The Seller has the right:

a) Add, remove or correct any information in the Online Store.

b) Cancel the order if the Buyer pays for the goods, but it is not possible to deliver the goods to the address specified by the Buyer and the Buyer cannot be contacted within 14 days either by phone or e-mail. The Buyer's order is canceled and the goods are returned to the Seller. In such a case, the Seller has the right to deduct the costs of delivery and preparation of the goods from the paid amount.

c) Terminate the purchase and sale agreement when, due to unforeseen circumstances related to the supply of goods or the fact that the goods are not in stock, the Seller cannot deliver the goods purchased in the Online Store, informing the Buyer about this. In such a case, the Seller may offer the Buyer a similar product, but if the Buyer refuses to replace the product specified in the order, the Seller undertakes to return the money paid by the Buyer within 5 business days to the Buyer's account from which the payment was made.

d) Restrict the Buyer's use of the Online Store services or cancel the Buyer's registration if the Buyer uses the Online Store in violation of these Rules or attempts to undermine the stability and security of the Online Store.

4.2. The seller undertakes:

a) To provide access to the services of the Online Store.

b) Deliver the purchased goods by the delivery method chosen by the Buyer, under the conditions set out in the Rules.

c) To constantly improve the functions of the Online Store, to ensure that the information provided therein is accurate, however, the Seller will not be liable for any loss or damage resulting from an attack on information systems, a virus or other software or technologically harmful or harmful material that may affect the computers, IT equipment, or data of persons using the Online Store.

 

5. Order

5.1. The price of the Goods indicated in the Online Store at the time of placing the order is final and valid for both the Buyer and the Seller, except in cases of obvious error. If the Seller determines that the price of any Goods ordered by the Buyer is incorrect, the Seller will inform the Buyer as soon as possible and the Buyer will be given the opportunity to confirm the order with the correct price or cancel the order. If the Seller is unable to contact the Buyer, the order will be considered canceled and all amounts paid by the Buyer will be returned to the Buyer. Prices in the Online Store are indicated in euros, including VAT. The price of the Goods may increase after adding the costs of delivery of the Goods, which depend on the selected delivery method.

5.2. The Buyer can order and purchase goods in the Online Store in one of the following ways:

a) By registering in the Online Store and creating an Account, specifying the data that is mandatory during registration. The Buyer can log in to his/her Account by entering the email address specified during registration and the password created by the Buyer;

b) Without registering an Account in the Online Store. In this case, the Buyer must provide his/her name, surname, email address, telephone number, information about the delivery address and other requested data.

5.3. Order confirmation will be provided to the Buyer at the Buyer's email address specified at the time of order confirmation.

 

6. Payment

6.1. Payment for goods is made via electronic banking or by direct bank transfer.

6.2. The Buyer shall pay for the goods in one of the following ways:

a) Electronic banking (using the Paysera payment system);

b) By bank transfer to an advance account. When choosing this payment method, the Buyer must indicate his order number in the payment destination field (e.g. #1234);

c) By bank card upon arrival at the company's registered office address (Šaltalankių g. 1, Klevinė, 14180 Vilnius district).

6.3. The Buyer undertakes to pay for the goods immediately. The goods are prepared and shipped only after the Buyer has paid for the order.

6.4. The Buyer agrees that the Seller will provide the invoice in electronic form.

6.5. When the Buyer pays for an order in the Online Store by bank transfer from abroad and subsequently returns the goods, additional fees for the bank transfer set by the bank may apply. These additional costs related to the bank transfer are paid by the Buyer.

7. Delivery of goods

7.1. When purchasing goods in the Online Store, the Buyer selects the delivery method and provides the exact delivery address.

7.2. We deliver goods in Lithuania, Latvia and Estonia.

7.3. We only deliver certain items to other foreign countries, by separate agreement and for an additional fee. To receive your order in a foreign country, please contact us. info@meda.lt or tel. +370 5 246 0054, + 37061427769.

7.4. Delivery in Lithuania:

a) Delivery to home, work or other specified address via DPD courier. If the order amount exceeds 45 EUR, delivery is FREE. In other cases – 3,99 EUR.

b) Delivery to a DPD Pickup parcel machine. If the order amount exceeds 45 EUR, delivery is FREE. In other cases – 2,99 EUR.

c) Delivery to Omniva parcel lockers. If the order amount exceeds 45 EUR, delivery is FREE. In other cases – 2,99 EUR.

d) The Buyer can pick up all orders FREE OF CHARGE in Vilnius, at the address Šaltalankių g. 1-1, Klevinė.

e) Delivery to the Curonian Spit using courier services is charged additionally + €22.

7.5. Delivery in Latvia:

a) Delivery to home, work or other specified address via DPD courier. If the order amount exceeds 99 EUR, delivery is FREE. In other cases – 10,99 EUR.

b) Delivery to a DPD Pickup parcel terminal. If the order amount exceeds 99 EUR, delivery is FREE. In other cases – 5,99 EUR.

c) Delivery to Omniva parcel lockers. If the order amount exceeds 99 EUR, delivery is FREE. In other cases – 5,99 EUR.

7.6. Delivery in Estonia:

a) Delivery to home, work or other specified address via DPD courier. If the order amount exceeds 129 EUR, delivery is FREE. In other cases – 12,99 EUR.

b) Delivery to a DPD Pickup parcel machine. If the order amount exceeds 129 EUR, delivery is FREE. In other cases – 6,99 EUR.

c) Delivery to Omniva parcel lockers. If the order amount exceeds 129 EUR, delivery is FREE. In other cases – 6,99 EUR.

d) Delivery to the Estonian islands using courier services is charged additionally + €14.

7.7. The Buyer undertakes to accept the goods. If he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims against the Seller regarding the delivery of the goods to an inappropriate entity.

7.8. The Seller is exempt from liability for violation of the terms of delivery of goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or the courier.

7.9. Upon receipt of the goods, the Buyer must check the condition of the shipment (whether the outer packaging is damaged). If the Buyer notices that the packaging of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this in the shipment transfer and acceptance document, when the goods are delivered by a courier - draw up a package damage report, and inform the Seller about it. If the Buyer fails to perform these actions, the Seller is released from liability for damage to the goods and for discrepancies in the package of goods, if these discrepancies can be identified by inspecting the exterior of the goods. Buyers who have collected the shipments at the parcel self-service terminals and have noticed discrepancies must immediately (within 1 day) inform the Seller about this.

7.10. The characteristics of all goods sold are indicated in the Online Store, in the description of each item. The Seller is not responsible for the fact that the color, shape or other characteristics of the goods in the Online Store may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

 

8. Return and exchange of goods

8.1. The Buyer may exchange or return defective goods within 14 days from the date of receipt of the goods.

8.2. Almost all goods can be exchanged or returned if they have not been used, are not damaged, have retained their usable properties, have not lost their commercial appearance and you have evidence confirming that the goods were purchased in the Seller's e-shop (i.e. the Buyer provides the order number or invoice number). Those packaged goods that have been unpacked after delivery and which are not suitable for return for health or hygiene reasons (for example, cosmetics, disposable masks, hygiene products, swimwear, socks, etc.) cannot be exchanged or returned. The entire list of non-returnable goods is regulated by Lithuanian legislation.

8.3. Exchanged or returned goods must be in their original, undamaged packaging, their labels must not be removed or damaged, and they must be of the same configuration. If the goods are not fully completed, are not in order, have damaged packaging, or have clear signs of use, the Seller has the right not to accept the goods, not to exchange them, and not to refund the money paid for the goods.

8.4. In order to return a product purchased in the Online Store, the Buyer must contact the Seller by phone +370 52460054; +37061427769 or by e-mail info@meda.lt and coordinate the return or exchange. When coordinating the exchange of goods, the Seller checks whether the desired new item is in stock and only after receiving complete information from the Seller, the exchange of goods is further coordinated.

8.5. Goods are returned to UAB "Meda LT”, at Šaltalankių g. 1-1, Klevinė, 14180 Vilnius district.

8.6. If the product is returned via courier services, the Buyer must pack it properly so that the product is not damaged during shipping. If the product is damaged during shipping, the Seller has the right not to accept the product.

8.7. The Seller shall transfer the amount paid for the goods to the Buyer's bank account within 7 days from the date of return of the goods. The money shall be returned to the same bank account from which the payment for the goods was made. No money shall be refunded for courier services.

8.8. The Buyer shall return quality goods at his own expense.

8.9. In the event of an exchange of goods, the Goods are replaced and shipped after the Buyer pays for the re-delivery. The applicable shipping rates are indicated in the section ShippingIf the goods were delivered to the Buyer for the first time free of charge, standard delivery charges apply when sending the goods again. rates.

 

9. Warranties

9.1. The characteristics of each product of the Electronic Store are generally indicated for each product.

9.2. Certain goods are provided with a manufacturer's warranty, the specific term or other conditions of which are indicated in the descriptions of such goods in the Online Store and detailed in the product warranty card.

9.3. Please report any defects noticed during the use of the goods to the contacts specified in clause 1.1 of these Rules. The Seller shall repair, complete or replace any quantitative or qualitative discrepancies identified during the warranty period with quality ones at its own expense. The Seller undertakes to eliminate the manufacturing defect that has arisen within 15-45 working days from the date of registration of the claim with the company.

9.4. The Buyer loses the right to free warranty service in the following cases:

a) the goods were damaged due to the fault of the buyer;

b) the goods were damaged due to Force majeure.

9.5. Many devices, even during the post-warranty period, can be inspected, repaired, upgraded and other maintenance work can be performed by the Seller at the Buyer's request and for an additional fee.

 

10. Processing of personal data

Personal data provided by the buyer is processed In the privacy policy in accordance with the specified procedure and conditions.

 

11 Final Provisions

11.1. The Seller reserves the right to change and supplement these Rules and other documents related to these Rules at any time. Additions or changes to the Rules shall enter into force on the date of their publication. When purchasing in the Online Store, the rules in force at the time of placing the order shall apply.

11.2. The Parties are exempted from the performance of their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties, which are provided for in the Rules on Exemption from Liability in the Event of Force Majeure approved by the Government of the Republic of Lithuania and other legal acts of the Republic of Lithuania.

11.3. All copyrights and other intellectual property rights to the textual or graphic content of the Online Store belong to the Seller or a third party providing the content. It is prohibited to use or distribute the content of the Online Store without the written consent of the Seller.

11.4. The Seller does not assume any risk and is unconditionally exempted from liability if the Buyer has not thoroughly familiarized himself with these Rules, although he has been given such an opportunity.

11.5. The law of the Republic of Lithuania shall apply to relations arising from these Rules. All disagreements arising from the implementation of these Rules shall be resolved amicably through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
